Introduction

 

Asusnotebooks.co.uk is an eshop owned by ‘City Computer Systems Ltd ’. Asusnotebooks.co.uk is not a company in its own right, it is a marketing, information eshop for City Computer Systems Ltd. City Computer Systems Ltd does not have a shop front.  City Computer Systems Ltd is a web-based company and trades as a distance selling company. We provide a mailing address for all forms of correspondence. For all buyers/consumers/customers/cliental we provide dedicated email mailing addresses to support all different enquiries and dedicated telephone lines. All transactions under this eshop are the full responsibility of City Computer Systems Ltd. All Invoices, in relation to any transactions from this eshop are issued by City Computer Systems Ltd. City Computer Systems Ltd and its staff supervise and are responsible for all sales, customer service, information and any form of correspondence to asusnotebooks.co.uk. This domain name, website, telephone lines, all contents and images on this site are owned by City Computer Systems Ltd. City Computer Systems Ltd sell goods and/or services on these terms. If you place an order on our website or by phone, these terms will apply.

 

Consumer Customers only: Nothing in these terms affects your statutory rights as a consumer.

Business Customers only: These terms supersede any previous oral or email discussions, but liability for fraudulent or grossly negligent misrepresentation is not excluded. Any variations to these terms must be agreed in writing (but not by email).

 

Please note: These terms & conditions are applicable for all orders placed from this website to City Computer Systems Ltd where we have issued invoices/transactions and any form of mail order.

 

2. Promotions

 

We may offer ongoing promotions, discounts, incentives or prizes on an ongoing basis subject to time scales or stock availability. We reserve the right to cancel any such promotional activity at any time without notice. It is the responsibility of the buyer/consumer/customer/client to confirm all promotional activity with City Computer Systems Ltd before placing any orders with us.

 

3. Website Errors & Advertising Errors

 

Occasionally errors can occur in descriptions or pricing of products, especially on the website. We therefore reserve the right where there has been an obvious error to cancel the contract by written notice or email to you, and to offer you the choice of a full refund (including delivery) or an exchange for the correct product and price or nearest equivalent.

 

4. Payment Methods & Terms

 

We accept the following methods of payments;

·         cash funds deposited into our business bank accounts,

·         cheque payments,

·         bacs transfer,

·         chaps transfer

·         credit and debit card payment.

 

Consumer Customers and Trade Customers without credit accounts: You must pay the purchase price in full on placing the order.

 

Business Customers with credit accounts:  You must pay our invoices within the agreed term of days of their invoice dates, or we may cancel your credit agreement, claim payment of all outstanding invoices and cancel / suspend any further deliveries. We may charge interest on late payments in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 plus our costs in attempting to recover payment and/or repossess the goods.

 

Discounts & incentives maybe offered at our discretion for cash payments made into our account. We reserve the right to cancel any incentives, promotions, discounts on payment methods at any time without notice. Please call for details.

 

5. Delivery Information

 

Carriage costs stated on the website applies to deliveries within United Kingdom only.

Delivery is not included in the quoted price of goods, except as may be stated in any offers on our website. See the Delivery Info & Cost section of our website for more information. Where applicable, your order will be delivered by our chosen courier. We reserve the discretion to select an alternative method or courier.

 

We despatch goods (in stock) on the same day if clear funds are received before the cutting off time of 16.30pm for delivery the next working day (unless otherwise stated). Where goods are not yet in stock, we despatch them as soon as stock arrives. You may wish to contact us to check for stock availability prior to placing the order. During the usual course of business you would usually receive delivery next working day, however, shipment may be delayed by the courier which is outside our control, especially during peak season. In such instances we apologise for any inconvenience caused.    

 

Consumer Customers buying by Distance Selling methods (e.g. website or telephone) only: If we cannot deliver the products you have ordered within 30 days (or any other period we agreed with you), we will inform you and offer you a full refund.

 

Please note: Upon delivery, the onus is on you to check the consignment prior to signing for it.  If you suspect any form of damage or any suspicions that your goods are missing, or any other concerns in which you feel that that your goods have not been delivered in an acceptable, new state, you must reject the consignment. You must immediately inform us by telephone or email of such incidents. It is the responsibility of the buyer/consumer/customer/client to check all products/items before signing as we may not be responsible for damaged or missing goods delivered to you in transit.

 

International deliveries

We deliver to many European countries. For international orders, carriage costs and other information please contact our customer service line and we would be happy to assist.   

 

6. Packaging

 

For computer and electronic products the original manufacturers' packaging is part of the goods, so please retain it for at least 28 days in case you wish to return them for any reason. Although your statutory rights as a consumer will not be affected, the goods are second hand without the packaging and we may not therefore be able to exchange them. We may have to charge you a restocking fee for such returns without the packaging. The restocking fee for missing or damaged packaging can range from a minimum of 5% to 10%.

 

We will not exchange or refund audio or video recordings or computer software after their protective wrapping has been removed, unless there is a fault in the product.

 

7. Your Right to Cancel & Returns

 

Consumer Customers buying by Distance Selling methods (e.g. website or telephone) only: You have the statutory right to a cooling off period until the 7th working day after the day you receive the goods, during which you may cancel the contract for any reason. It is advisable that you do not use the product should you want to cancel the contract for any reason. You must give us notice of cancellation in writing (which may be by fax or email), and return the goods to us at the following address:

 

City Computer Systems Ltd, 23 Colmore Row , Birmingham, B3 2EW, West Midlands. You must include your returns (RMA) number which will be provided by our customer services department. All returns must be confirmed by us before you can despatch the goods to us.

 

If the product is faulty please notify us immediately and we are happy to offer a replacement within 7 days on receipt of the product. If it is outside the 7 days period please contact the manufacturer, AsusTek direct.  

 

The onus is on the customer wishing to return the notebook to bear the return carriage costs. We advised that the postage should be insured as we cannot be responsible for items lost or damage in the course of delivery.  Please ensure the item is returned complete in its original manufacturers' packaging together with all accessories and manuals. Upon receipt we would issue a full refund within 7 days. We would not be able to issue a full refund if goods received are incomplete or damaged in any way. 

 

Please note: If you wish to return the product to us you must ensure that you do not register the operating software or any other software supplied with the product as this will not be classified as a new product once returned. Such products would be classified as ‘used’ goods, if returned to us it will not be refundable or we may at our discretion provide a partial refund with a charge for re-stocking fee which is a minimum of 15% of the Invoice price.

 

Business Customers only: If faulty goods are returned to us in the original manufacturer's packaging within 7 days of delivery, it would be sent to our dedicated engineers to perform a diagnostic on the product.  Faults will be reported to the manufacturer either by telephone or email, goods will be collected & return to the manufacturer for repair, or exchange them for equivalent reconditioned or second hand goods. If the goods are not faulty, or have been damaged by someone other than us or the manufacturer attempting repairs, we may refuse exchange or repair as above and/or charge handling fee of anything between 15% to 20% of the purchase price (plus VAT). All statutory implied terms as to the quality of the goods, fitness for purpose and correspondence with descriptions and samples are excluded to the maximum extent permitted by law.

8. Transfer of Ownership of Goods

 

The goods belong to us until we have received cleared funds, if goods has been dispatched you are responsible for their safekeeping upon delivery. You must return them or allow us to repossess them if your payment is dishonoured.

 

Business Customers with and without credit accounts only: Until you have paid for our goods you must retain them and the original manufacturers' packaging so that they can be identified as our property. You must allow us to enter your premises to recover them if you have defaulted on any payment due to us. If you sell them or make an insurance claim in respect of them, you must hold the proceeds on trust for us.

 

9. Warranties

 

In addition to your statutory rights as a consumer, we will pass on to you the benefit of any manufacturers' warranties or guarantees, subject to any conditions that may apply (which will be specified in the documentation accompanying the goods). These may require return in the original manufacturer's packaging. All notebooks have a 2 year collect & return warranty which is supplied by the manufacturer. This warranty is automatically activated on the 8th day from Invoice date. Prior to this date City Computer Systems Ltd will assist with all returns and/or fault enquiries.  Any additional warranties may incur additional costs. International warranty where supplied are only RTB – return to base in the country where the manufacturer has a returns/service centre. Goods will need to be sent to the relevant returns/service centre by the customer/client at their own discretion and responsibility. All returns must have original documentation of proof of purchase.

10.Liability

 

We strongly recommend that you make back-up copies of all your data and take appropriate precautions against viruses, hacking and other types of computer misuse.

 

Business Customers only: Our total liability to you for any reason (whether in contract, tort or by statute) is limited to the total order price (including VAT) plus any liability for death or personal injury caused by our negligence or that of persons for whom we are legally responsible. We will not be liable for damage to other property, or for any consequential losses (e.g. loss of data, business or profits, liability to third parties).

 

11. Applicable Law and Dispute Resolution

 

Your contract with us is made under English law. If a dispute cannot be resolved by agreement, you or we may refer it to be mediated or take it to an appropriate court in the United Kingdom

 

We have standards in place for all complaints procedures.
